FEMIGIRLS.PL STORE REGULATIONS

 

 

1. GENERAL INFORMATION

  1. The online store femigirls.pl (hereinafter collectively referred to as the " Store ") is run by Aleks Nowicki "Alex" with its registered office in Warsaw, address: 02-495 Warsaw, Jacek i

Agatki 4/13, entered into the Register of Entrepreneurs of the National Court Register kept by the District Court in Warsaw, 11th Commercial Division of the National Court Register under the KRS number ,

REGON 142713260, NIP 5222840217, which is also the administrator of the personal data of the Store's Customers. In the further provisions of the Regulations, in order to simplify communication, we use the term: "femigirls.pl",

“we” or use other pronouns to describe the first person plural.

  1. In the regulations (" Regulations ") we have described the rules for making purchases of goods presented in the Store (" Goods "), registering your account and other services described in the Regulations.
  2. You can check the regulations in the footer
  3. Information about the Goods that you can purchase in the Store is an invitation to conclude a sales contract within the meaning of the relevant legal provisions, in particular Article 71 of the Civil Code.
  4. The Goods in the Store are described in detail. The website contains information in particular about the properties of the Goods, their price, the material from which they are made.
  5. All trademarks and company names, photos, designs, Store layout, product descriptions and other elements are subject to copyright and may not be copied or used in any way for your own purposes without pl's consent.

1. RULES FOR USING THE STORE AND CONCLUDING A GOODS SALE AGREEMENT

  1. Read the Regulations and accept their content before placing an order or creating an account in the Store. Without accepting the Regulations, you will not be able to purchase Goods or use other services via
  2. The information you provide us with when placing an order should be true, up-to-date and accurate. Remember that we may refuse to process an order if the information provided is so inaccurate that it makes it impossible to process the order, in particular, it makes it impossible to properly deliver the shipment. Before refusing to process an order, we will attempt to contact you to establish the information to the extent necessary to process the order.
  3. We make every effort to ensure that your use of the Store is efficient and we operate in accordance with applicable safety standards in this regard.
  4. You may not take any action that may pose a threat to the security of the Store, the security of your data or the data of other customers, or the security of purchases made.
  5. When using the Store, you are obliged to comply with the following rules:

  1. a) you may not interfere in any way with the system environment of the Store, in particular by introducing harmful (malicious) software into it or taking other actions aimed at unlawful interference with the Store;
  2. b) you are obliged to use the Store in accordance with its intended purpose described in the Regulations – using the Store’s functionalities in any other scope than specified in the Regulations is prohibited;
  3. c) you may not use the Store in a way that could disrupt its operation or cause inconvenience to other users or Store employees, in particular you may not send advertisements or other information of this nature to the addresses available on the Store's websites,
  4. d) you are not authorized to use the content, descriptions, photos or other graphic elements of the Store for your own use or the use of other entities. Remember that all such elements of the Store are covered by copyright and cannot be used without its consent.
  5. For some brands of Goods we have introduced restrictions on the number of modelokolor pieces you can buy in one order. You will be informed about this when you add the maximum number of pieces to your Cart within a given order.

III. CONCLUSION OF A GOODS SALE AGREEMENT

 

  1. In the Store you can purchase Goods and use the services provided by pl under the terms described in the Regulations.
  2. You can place orders in the Store 24 hours a day, but orders placed on non-working days (Saturdays, Sundays and holidays) will be processed on the next business day.
  3. You can place an order after logging in to your account in the Store or by placing an order as a guest.
  4. We will ask you to provide the data necessary to process your orders. We will mark all necessary data in the purchase form as Without providing the required data, we will not be able to process your order and issue an invoice.
  5. To place an order you will need to follow these steps:
  6. a) after selecting the Goods, add them to the "Basket" by selecting the appropriate size, quantity of Goods, their color, and then go to the "Basket" and follow the further instructions on the Store website,
  7. b) you can change the contents of your "Basket" by removing Products or adding new Products, as well as changing the data provided until you click the "Order and pay"/"pay now" button,
  8. c) clicking the "Order and pay"/"pay now" button means that you have made us an offer to purchase the Goods you have selected on the terms described in
  9. After submitting your offer, you will receive an e-mail containing basic information about your order, including: the quantity of ordered Goods, their price and delivery costs, the selected type of delivery and payment, the estimated time of order fulfillment, your data and data. This e-mail will also contain information on how to file a complaint and the rules for withdrawing from the sales contract. Remember that this

the message only confirms that the Store has received your order.

  1. Once we receive your order, we will inform you that it has been forwarded to the warehouse for verification, and then after the order has been verified, we will send you another email in which

we will confirm the fulfillment of your order (“ Order Confirmation ”) or refuse to accept your offer to purchase Goods from the Store and indicate the reasons for the refusal.

  1. The email message indicated in point 7 above ( "Order Fulfillment Confirmation ") means that the sales agreement for the Goods selected by you has been concluded on the terms described in this
  2. You can try to cancel your order at any time - just contact Customer Service. If you decide to cancel your order, we will always send you an email confirming the cancellation of your order.
  3. If you have chosen to pay online, your order will be canceled if:
  4. a) the contact details are so inaccurate that it prevents delivery or contacting you to confirm the details,
  5. b) Your payment for your order is not received within 5 business days
  6. For placed orders we issue an electronic, personalized receipt for the purchased Goods. You will receive such a receipt to the email provided when placing the order. In order to obtain an invoice for a given order, you must contact our customer service department: kontakt@femigirls.pl

14. DELIVERY AND COLLECTION OF GOODS

 

  1. Goods purchased in the Store will be delivered to the address indicated by you in the order in the territory of the Republic of Poland. You can also indicate the address for delivery of Goods to selected countries outside Poland under the terms and conditions specified in point VIII of the Regulations.

  1. We usually process orders within two business days, depending on the selected method of delivery of the Goods. The delivery of your order may be delayed during periods of increased shopping in the Store, during holiday periods, however we make every effort to ensure that your purchases reach you within a maximum of 7 days from the receipt by you of the Confirmation of shipment and order. We may delay the processing of your order until we have recorded payment for the Goods, in the case of choosing online payment.

  1. We will deliver the goods to you in the following way:
  2. a) by courier to the address you indicated in Poland,
  3. b) to the selected collection point – according to the options provided by pl

1. PRICES AND PAYMENT METHODS

  1. The prices of the Goods in the Store are given in Polish zloty. The prices given include tax
  2. You can pay for your order by selecting one of the payment methods available in the Store. Payment methods available in the Store are presented on the subpage

  1. Remember that we can change the prices of Goods in the Store, change the assortment, introduce promotions or other product discounts, but such changes will not violate already concluded sales agreements or the rights of Customers who use a specific

1. COMPLAINTS ABOUT GOODS

  1. In the shop we sell only new and original products.
  2. If you believe that the Goods you have purchased are inconsistent with the contract/defective, you may file a complaint in accordance with the relevant legal provisions and provisions
  3. You can submit a complaint in the following way:
  4. a) return the Goods subject to the complaint with a written description of the defect - you can use the complaint form provided by us, downloaded from the Store's website, but this is not necessary,

  6. c) you will receive information from us about how your complaint will be handled within 14 days from the date we receive the complaint from you
  7. Extrajudicial methods of resolving disputes:
  8. a) We inform you that a Customer who is a consumer has the right to use the following out-of-court methods of handling complaints and pursuing claims:

  • the possibility of filing a request for conducting proceedings on the out-of-court resolution of consumer disputes on the basis of the Act of 23 September 2016 on the out-of-court resolution of consumer disputes (Journal of Laws of 2016, item 1823), i.e. e.g. to the Provincial Inspector of Trade Inspection in Warsaw.

  1. b) At the same time, we would like to inform you that the above procedure is voluntary and both parties must consent to it.
  2. c) If you purchase Goods as a consumer, you are also entitled to use an out-of-court method of resolving disputes and seeking redress.

Pursuant to Article 1 of the ODR Regulation, the purpose of the ODR platform is to provide consumers with a tool facilitating independent, impartial, transparent, effective, fast and fair out-of-court online resolution of disputes between consumers and traders within the territory of the European Union.

The provisions of this point VI above shall apply accordingly to a natural person concluding a contract directly related to their business activity, when the content of this contract indicates that it does not have a professional character for this person, resulting in particular from the subject of the business activity performed by them, made available under the provisions on the Central Register and Information on Business Activity.

VII. RETURN OF GOODS - WITHDRAWAL FROM THE SALES AGREEMENT

 

  1. If you purchase Goods as a consumer, you may withdraw from the concluded sales contract without giving reasons, on the terms set out below. You do not have the right to withdraw from a distance contract in relation to contracts:
  2. the sale of sealed goods that are not suitable for return due to health protection or hygiene reasons and whose packaging has been opened after delivery;
  3. the sale of sealed audio recordings or sealed video recordings or sealed computer software, the packaging of which has been opened after delivery;
  4. sale of newspapers, periodicals or magazines, with the exception of subscription contracts.
  5. You may withdraw from the contract of sale of Goods in the Store within 30 days from the date of receipt of the Goods.
  6. You can exercise your right of withdrawal in the following ways:
  7. a) inform us about your decision to withdraw from the contract by e-mail to kontakt@femigirls.pl
  8. b) use the withdrawal form and include it in the return package.
  9. c) if you submit a declaration of withdrawal from the sales contract to the Store's e-mail address, we will immediately confirm receipt of such declaration in the feedback sent to your e-mail address,
  10. d) you will meet the deadline for withdrawal from the contract if you send the parcel by post or send us an e-mail with a statement of withdrawal before it expires,
  11. e) send the Goods subject to withdrawal from the contract to the following address:

  1. If you withdraw from the contract for the sale of Goods:
  2. a) you will be obliged to cover the costs of returning the Goods to us that are the subject of the withdrawal,
  3. b) We will return the payments received from you immediately, but no later than 14 days from the date of receipt of your declaration of withdrawal. We will also return the delivery costs if you return all the Goods purchased in one order. We may withhold the return of your payments until we receive the returned Goods from you or you send proof of sending back the Goods - whichever comes first.
  4. c) We will make the refund using the same method you used to make the payment, unless you agree to the refund using another means

– in any case, you will not incur any additional costs related to the refund of the amounts paid,

  1. However, remember that under the law you are responsible for any reduction in the value of the returned Goods resulting from their use in a manner other than necessary to establish the nature, characteristics and functioning of the purchased Goods.
  2. The provisions of this point VII shall apply accordingly to a natural person concluding a contract directly related to his/her business activity, when the content of such contract indicates that it is not of a professional nature for that person, resulting in particular from the subject of the business activity performed by him/her, made available under the provisions on the Central Register and Information on Business Activity.

X. INFORMATION ABOUT SERVICES PROVIDED ELECTRONICALLY

 

  1. Through the Store femigirls.pl provides the following services to Customers electronically:
  2. a) enabling the conclusion of online sales agreements for Goods in the Store, in accordance with the Regulations,
  3. b) enabling viewing of content on the Store’s websites.
  4. You are entitled to withdraw from the concluded sales agreements for Goods in the Store under the terms specified in the relevant legal provisions and in
  5. To use the Store in accordance with its functions, you need:
  6. a) access to the Internet,
  7. b) using a typical web browser such as Chrome, Safari, Opera, FireFox or similar,
  8. c) email accounts
  9. You can file a complaint regarding the services provided by femigirls.pl by sending an e-mail message to the Customer Service Office: kontakt@femi-girls.pl or by contacting the Customer Service Office by phone. When filing a complaint, describe what it concerns, and also indicate your expectations as to how it should be handled. We will consider your complaint as soon as possible, and in any case you will receive a response within 14 days of receiving your complaint.

10. FINAL PROVISIONS

  1. Before concluding a product sales agreement in the Store, you should read the Regulations and accept their content. With each order, we enable you to read About changes to the Regulations

we will inform you by e-mail if you have an account in the Store. If you do not accept the planned changes, you can request the deletion of your account in the Store at any time.

  1. We apply the law to the sale of products in the Store.
  2. In matters not regulated in the Regulations, we apply the relevant provisions of law.
  3. We may change the Regulations in cases such as:
  4. a) changes in legal provisions or their interpretation by relevant bodies or as a result of court decisions, as well as explanations, interpretations or recommendations issued by relevant state bodies, if this is significant for the provisions of the Regulations,
  5. b) a change in the method of providing services covered by the Regulations, which may be caused by technical and technological reasons, security reasons, the need to improve the operation of the Store or to improve the quality of the services we provide,
  6. c) changing the scope or method of providing services under the Regulations by introducing new functions or services, modifying or withdrawing existing functions or services,
  7. d) change of payment or shipping methods,
  8. e) the need to introduce changes
  9. Amendments to the Regulations apply to contracts for the sale of Goods in the Store concluded after the entry into force
